Chapter 40-6 of the Rhode Island General Laws, as amended, and Title XIX of the Social Security Act

Purpose and Reason:

The Executive Office of Health & Human Services (EOHHS) is filing an “emergency” rule to incorporate recent changes to the Federal Poverty Levels (FPLs) into existing applicable rules. Medicaid Code of Administrative Rules Sections #0396, 0384, and 0362 are affected by these changes. Effective April 1, 2014, this Medicaid rule (#0396) will be amended to reflect the 2014 changes in the FPL guidelines that were cited in the February 7, 2014 Informational Bulletin from the Centers for Medicare and Medicaid Services. These rules are also being amended to update related sections of the Medicaid policies to reflect 2014 cost of care figures.

Brief statement of Reason for Finding Imminent Peril:

The State is adopting these amended rules on an “emergency” basis to set forth these provisions in a timely basis in order to prevent wrongful denial, discontinuance, or interruption of benefits.
